ACCEPTABLE USE POLICY

1 By connecting to BigPond Chat, you hereby acknowledge that you have read and that you agree to comply with:

1.1 Telstra.com Terms of Use

1.2 BigPond Chat Acceptable Use Policy (this document, available also at http://bigpond.com/chat/docs/AUP.asp)

1.3 The policies, which are stated on each server's Message of the Day ("MOTD") (to read the MOTD on line type /motd).

1.4 BigPond Chat etiquette

2 What you must not do:

2.1 Use profane or vulgar language,

2.2 Use, facilitate or plan denial of service ("DoS") actions, tools or methods.

2.3 Mass message (unsolicited messages or notices sent to multiple users and / or channels),

2.4 Mass invite (unsolicited invitation sent to multiple users and / or channels),

2.5 Flood (excessive number of messages send to an individual, channel, service or server, repeat the same phrase(s), command(s), word(s) or character(s) with intent to flood)

2.6 Clone (create multiple concurrent connections from the same IP). BigPond Chat will accept 3 concurrent connections if your IP resolves to *.tmns.net.au or *.BigPond.net.au, otherwise you have 2 concurrent connections per IP. This is intended to accommodate home networks. The limits are not guaranteed and may change dynamically.

2.8 Utilise chat for sexually explicit content

2.9 Create channels or other chat entities with primary purpose of file distribution

2.10 Continuously type using capital characters. (This is referred to as CAPS and by convention capital case is considered rude and/or shouting)

2.11 Disobey service or channel operators

2.12 Avoid service, server or channel bans

2.13 Utilise unsecured proxies or any other means to disguise your connection address (IP)

2.14 Connect known viruses or exploits

2.15 Take over channels

2.16 Disclose your chat password

2.17 Attempt to use or steal passwords of other chatters, channels or any other services

2.18 Impersonate a member of the BigPond Chat team

2.19 Register chat rooms for commercial purposes without prior agreement with BigPond Chat.

3 We reserve the right to:

3.1 Disconnect any chat session deemed to be against Telstra.com Terms of Use or BigPond Chat Acceptable Use policy or any chat session deemed to negatively impact the Chat service without prior warning, notification or justification

3.2 Scan every connection for well known Trojan viruses and exploits

3.3 Close, filter, deregister, or refuse registration of any channel without prior warning, notification or justification

3.4 Block, filter, deregister or refuse registration of any nickname without prior warning, notification or justification

3.5 Filter any word, phrase or message without prior warning, notification or justification

3.6 Deny access to or use of its services to any individual(s), organisation or domain,

3.7 Contact you by email in order to provide you with assistance if you request a password reset.

3.8 Control, monitor and log transmitted content. This right does not constitute an obligation.

3.9 Alter this BigPond Chat Acceptable Use Policy and any terms and conditions. We will notify you about such changes in Message of The Day ("MOTD").

3.10 Our failure to exercise or enforce any right or provision of the BigPond Chat Acceptable Use Policy shall not constitute a waiver of such right or provision.

4 You acknowledge:

4.1 You have no rights to any data maintained or transmitted on or by BigPond Chat

4.2 BigPond Chat does not guarantee the accuracy, suitability, quality or integrity of any information transmitted on the service

4.3 BigPond Chat will not be liable for any transmitted content, its use, its loss, its errors or any damage sustained as a result of its use or transmission.

4.4 BigPond Chat team consists mainly of volunteer staff. It can provide help and guidance but has no obligation to do so.

4.5 Members of the BigPond Chat team will interpret this AUP if there is any ambiguity.

4.6 You will supervise use of chat by persons in your care under the age of 18 as some content may not be suitable for them. BigPond Chat cannot ensure the suitability of transmitted content for use by children.

4.7 To the extent permitted by law, neither Telstra Corporation Limited nor any of its officers, employees, agents or related bodies corporate will be liable in any way (including for negligence) for any loss, damage, costs or expenses suffered by you or claims made against you through the use of BigPond Chat.
